Payment Agreement

You are welcome to purchase the Crush paid service. By purchasing a Crush paid services, you will be able to use the exclusive features of the corresponding Crush paid services by paying for them.

 

Acceptance And Modification of This Agreement

1. This Payment Agreement (this “Agreement”) is between us and you regarding the purchase and use of the Crush Subscription Service, which is paid for and you are not entitled to use the Crush Subscription Service exclusive features and other services covered by this Agreement unless you agree to and accept all of the terms of this Agreement and complete the payment process.

2. According to the changes of relevant laws and regulations, Crush will continuously improve the quality of service and modify this Agreement accordingly. After the new version of the agreement is published, you can check the latest version of the agreement in Crush App. Unless you already enjoy the matters before the new agreement takes effect, your rights and obligations, purchase related procedures and charges are subject to each clause in the latest version of this Agreement and the purchase page display.

3. Please read carefully and choose whether to accept this Agreement, and you must fully and strictly comply with the terms of this Agreement when enjoying the Crush Subscription Service.

 

Paid Service Purchase

1. Before purchasing the Crush Subscription Service, you must review and agree to accept the relevant Terms of Service and this Agreement. At the same time, you must ensure that the personal information you fill in is true, accurate and valid, otherwise Crush has the right to suspend your subscription service. You fill in the personal information changes, should promptly modify the registered personal data, otherwise the resulting subscription service rights can not be fully and effectively exercised by the responsibility of your own.

2. Crush users can use the Crush Subscription Service after completing the user registration process and paying for the corresponding services through the payment methods provided by the Crush Platform. After purchasing the Crush Subscription Service, you may not rent, borrow, transfer or license it to a third party, and you may not open the Crush Subscription Service for yourself or others for non-personal use such as profit or business.

3. Based on different cell phone operating systems, the price of the paid service may vary depending on the system platform, and the actual price of each subscription service is subject to the actual price listed on the purchase screen.

 

Subscription Auto-Renewal

1. The subscription auto-renewal service is a service that is offered to you in response to your demand for auto-renewal service and to avoid losses caused by your failure to renew your subscription in time due to negligence or other reasons, if you have opened the subscription services. If you choose to use the auto-renewal service, you authorize Crush to debit your own top-up account, third party payment account tied to your account, bank card, communication account with the next billing balance when the validity of your purchased subscription services is about to expire.

2. Crush will charge you for the subscription services for the next billing cycle through the above-mentioned account, and you shall be responsible for any failure to renew the subscription due to insufficient balance available for debiting in the above-mentioned account. For the chosen payment channel, you are obliged to ensure that you regularly monitor and ensure that there is sufficient balance under the account of the payment method for the application of the automatic renewal of the subscription services. Crush may suspend the provision of subscriptions to you if the automatic renewal requirement cannot be met due to the aforementioned defects (including, but not limited to, insufficient balance to satisfy your subscription to the auto-renewal service).

3. After you have chosen to automatically renew your subscription with Crush, you can cancel the automatic renewal on your own.

4. Crush may from time to time adjust the content of free services and paid services, such as package prices, benefits. If you turn on auto-renewal, we will notify you in advance through announcements, emails, etc. of upcoming changes to the content of paid services so that you can choose whether to continue auto-renewal.

5. If you do not cancel the auto-renewal at least 24 hours before the end of the subscription period, you are deemed to have agreed that Crush will continue to debit in accordance with this Agreement and the auto-renewal cycle you have selected, and once the debit is successful, Crush will open the Crush subscription services for the next billing cycle for the you.

 

Risks And Responsibilities

1. You should purchase Crush paid services through channels within the Crush products. The purchase of services through other channels may involve certain business risks (including, but not limited to, the use of your account or bank card by unscrupulous persons for illegal activities). All economic losses caused by these commercial risks to you, as well as the consequences of pursuing infringement liability from infringing parties and the inability to pursue liability, are your personal responsibility.

2. Unless Crush is at fault, Crush shall not be liable and shall not compensate you for any damages caused by the acts or omissions of third parties, including but not limited to any infringement by any third party such as payment services, network access services, etc.

 

Fees Refund

In the following circumstances you are entitled to request a monetary refund:

1. If it is proven that your card was used fraudulently on our website your money will be refunded. Should you suspect credit card fraud, please contact us immediately and we will investigate.

2. For erroneous purchases made by you, provided that these are not systematic requests (one time only):

 If the purchased Virtual Item are not spent, then you are entitled to a full refund.

 If the purchased Virtual Item are spent partially, then you are entitled to a partial refund.

3. In case we terminated your subscription for any reason, with or without explanation. In such a case, you shall receive a refund, pro rata, of any paid but unused fees that we have received from you.

If your subscription was terminated by reason of violation of our Terms of Use and Privacy Policy, or at your request, you will not be entitled for any refund of unused fees.

The money refunded will NOT exceed the amount paid for a particular service or product.

 

Membership Cancellation

You may terminate Your subscription at any time, for any reason, effective upon receipt of Your written notice of termination by Crush customer support staff. Your subscription will be cancelled effective from the next subscription month following your request to cancel the said subscription, however any fees charged for previous subscription, used or used Virtual Item within the current subscription month will not be refunded, notwithstanding the provisions of the refund as set out in this Refund and Cancellation Policy.

 

How to Request Refund or Membership cancellation

For enforcement of the refund or subscription cancellation please contact our support team directly. Once your request is approved, you will receive a refund to your designated account, as set forth above. We will review and get back to you with an initial reply to your request within 72 hours.

 

Account Cancellation

When you cancel your account, your personal information under your account will be deleted or anonymized, unless otherwise provided by law or this Agreement. Once your account has been cancelled, it cannot be restored.

1. Before you apply/continue to apply for account cancellation, to protect your account security and related rights, you should first check and ensure and commit that the account you apply for cancellation has met the following conditions, which include but not limited to:

 Your account is legally owned and logged in by you and complies with the Terms of Use and related rules regarding accounts.

 Your account is in a secure state: the account is in normal use, is not in violation processing status, and is not otherwise at risk.

 The Virtual Item in your account has been closed out or properly disposed of. Please dispose of your Virtual Item properly, if it is not disposed of at the time of cancellation, you are considered to have voluntarily given up such Virtual Item.

 Your account has no outstanding orders.

 Your account is free of any disputes: including complaints, reported complaints, investigations by state authorities, arbitration, litigation and other disputes.

2. If you have applied to cancel your account, please do not log in to this account within 15 days. If you choose reactivate your account, you will immediately cancel the cancellation application and log in to this account.

3. You acknowledge and agree that cancellation of your account will (and may) have consequences including, but not limited to, the following, which you will be solely responsible for:

 You will not be able to log in, use your account, and your friends will not be able to interact with you in Crush.

 Unless otherwise specified by Terms of Use, personal information under your account will be deleted or anonymized. You will not be able to retrieve your personal information, nor will you have the right to request that we do so.

 You acknowledge that if your account is cancelled, your Virtual Items will also be deleted from your account, and you agree not to seek restoration or compensation from us for such Virtual Item.

 Once your account is cancelled, it cannot be restored. Even if you sign up for Crush again with the same Google Play, Facebook, Apple ID or other approved account after you have logged out, that account will be considered a new user account.

 Once your account has been cancelled, Terms of Use you have entered into with us in relation to Crush will terminate (unless it has been agreed to continue in force). However, the termination of these agreements does not affect your liability for your use of the Crush service prior to account cancellation, and you will remain liable for your use of the Crush service prior to account cancellation, including, but not limited to, any liability for breach of contract, liability for damages and performance obligations that may arise.

 Other consequences that (may) arise from account cancellation.
